Read the rule for the specific year
Supplemental availability, when authorized and implemented, comes with its own dates, allocation conditions, and filing instructions. Use the actual rule and current USCIS announcements. A prior year’s allocation size or worker-history requirements should not be carried into another year.
Check the entire case, not just the worker history
Review the employer’s need, certified labor application, petition requirements, and any special attestations together. Previous H-2B participation alone does not establish that a worker or employer qualifies for a particular allocation. Keep the evidence supporting any special condition.
Make a decision using current information
Before paying outside costs or making travel commitments, confirm the official filing status and the risks if an allocation closes. Ask how the written service agreement handles fees and work already performed. Keep a staffing plan that does not depend on unconfirmed supplemental numbers.
