Late H-2B planning: what to review before the next step

If your season is close, begin with an honest assessment of the dates and case status. A later start, an exception, or a cap-related pathway cannot be assumed to be available.

Identify what is actually missing

Separate wage preparation, the standard DOL application window, recruitment, USCIS petition status, and consular processing. Missing an early planning target is different from missing an agency deadline. Bring notices, prior filings, and the genuine date of need to the review.

Review options without changing the facts

A revised start date must reflect a real business need. Special procedures, cap exemptions, or supplemental allocations depend on their own requirements and current instructions. Get an individual review before relying on any of them. A previous H-2B season does not automatically create an exemption.

Protect the business while planning ahead

Maintain lawful staffing alternatives and a realistic operating plan. Do not promise work before authorization is confirmed. For the next season, collect monthly staffing records now and begin wage and case preparation well before the labor-application window.
